DUI Lawyer in Lynn, MA

Massachusetts uses specific blood alcohol benchmarks that decide how your OUI case gets handled, and they’re not all the same number or treated the same way under the law. A DUI lawyer in Lynn, MA, can help you understand where your test result falls on that scale, and which suspension rules apply to your age and history.

The BAC Numbers

For adults, 0.08% or higher is the per se threshold for an OUI conviction. Between 0.05% and 0.08%, the law allows no permissible inference either way on impairment, meaning the number alone proves nothing. At 0.05% or below, there’s a permissible inference that you weren’t under the influence of alcohol at all.

For drivers under 21, a separate administrative threshold of 0.02% triggers zero-tolerance consequences, but that number doesn’t replace the 0.08% criminal standard used for adults. A driver under 21 can still be convicted under the impairment theory at a lower BAC if the evidence otherwise supports it.

A DUI lawyer in Lynn, MA, can explain how the applicable BAC threshold and the surrounding evidence may affect your case.

Under 21 Penalties

A person under 21 with a BAC of at least 0.02%, or who refuses a chemical test, faces an additional suspension under Section 24P, 180 days for ages 18 to 20, and one full year for anyone under 18. These apply regardless of how the underlying criminal charge eventually turns out.

A first-time underage driver may be able to waive the additional suspension by completing an approved program. Still, anyone who was under 18 at the time still faces the full 180-day suspension period even after completing it.

Refusal Suspensions

If a chemical test is refused rather than failed, the suspension length depends heavily on your prior record. With no qualifying prior and age 21 or older, it’s 180 days. Under 21, or with one qualifying prior or program assignment, it jumps to 3 years. Two qualifying priors push it to 5 years, and three or more priors can mean a lifetime suspension. These refusal periods run separately from the under-21 administrative suspensions described above.

Ignition Interlock Rules

IID installation is mandatory for second, third, and fourth offenders seeking a hardship license, and it can also apply to a first offender whose BAC was 0.15% or higher at the time of testing. Once required, it generally stays in place through the full suspension period plus two additional years on top of that.

Your BAC result is only one piece of a Lynn OUI case, and the under-21 and refusal rules add layers most people don’t expect going in. Mixing up which threshold or which suspension table applies to your case can lead to the wrong assumptions about what’s at stake.
