Law enforcement applied for a criminal complaint seeking to charge the defendant with rape. At a Clerk’s Hearing, Attorney Riccio argued there wasn’t enough evidence to charge his client with rape and the court agreed but moved forward with a complaint charging the defendant with one count of indecent assault & battery. Attorney Riccio’s client adamantly denied the allegations and refused to accept any plea agreement. On the day of trial, the alleged victim did not appear and the case was dismissed.
